So I have read the EULA, searched the forum and emailed support, and they referred me back to the EULA. Maybe I am bit slow. If someone creates a musical arrangement or song using their licensed ACID and ACID loops and then sells the song (I got that part), can the person who bought the song then sell it again and/or negotiate royalties free of any restrictions from Sony or anyone else? I'm trying to understand what you are getting at because there seems to be two sales in your scenario. Let's take them one at a time: (1) If you create a song using Sony ACID Loops (not someone else's ACID loops because each library has it's own EULA) then they are royalty free. You own the song and owe Sony nothing. (2) If you turn around and sell that song, the buyer is bound by whatever terms you impose on them because you now own the song (i.e., they owe Sony nothing since the song is yours to do with as you like). If you sell it to them outright and release your rights, then they can do whatever they want and relicense it for royalties etc. Songs created with Sony ACID Loops are no different than songs that are completely recorded by you. That's what "royalty free" means. Disclaimer: I am not a lawyer and this advice should not be considered legal advice. It is, however, the whole idea behind royalty free loops. There's only one caveat to that which was pointed out on this forum quite a while ago: you can't actually name the musicians who produced the ACID loops in your credits. Thus you're not allowed to list Mick Fleetwood (or whoever) as your drummer, and neither can the person or company you sell the song to. |
