Subject:lounge ethics/legalities (cover songs)

Given the release statement on the lounge upload site, is it
legal or ethical to release an ACID cover song if the song
is older than 25 years and the origional artists and
copywrite information is stated?

Also, are loops released with contests on this site
considered "public" Sonic Foundry loops, making them
available to use in music released on the lounge?
