Subject:Acid loops as synth samples - copyright

I have been reading about a software synth group where users contribute new patches to share. This software can use samples. So an ACID loop could be used as a sample in a custom patch. The issue is that loop sample is being distributed to other users as part of the new patch, so someone else could get that loop for free. So at what point is that loop free to distribute sell, whatever. Do you just add some eq and change the file name? would you need to combine 2 loops and render it out as a new one, or can you simple not do it?

Read the Acid Loop licence. They are not for on-selling or distribution (as you would expect!).

You may be right, but, I am not convinced that the situation I have described is catagorically disallowed based on the EULA, which I have read a few times:
http://www.sonymediasoftware.com/loop_libraries/eula.asp

"Neither the Content CD nor any portion thereof may be resold or redistributed as loops, music beds, clips, visuals and/or graphic images except as otherwise integrated into your own works."

Could "my works" be a custom sample created using ACID loops and "integrated" into a original synth patch.

I have an email into Sony...

I'm with Jumbuk. I would interpret this to mean music I have composed, and nothing else. I would be interested to hear what Sony's response is.

I interpret this to basically mean that if you make commercial projects out of these samples, it's A-OK, but if you try to repackage them as samples for use separately in someone else's work, then you may be entering some legal hot water.

I got a reply a few days ago, here is their answer:

*****************************************************
Thank you for writing. The sale of reproduced or repackaged individual loops from our loop libraries is forbidden.

The Loops are royalty free when used in a compilation, you cannot distribute individual loops.

The End User License Agreement for our Loops for ACID libraries can be found at http://www.sonymediasoftware.com/loop_libraries/eula.asp.

Sincerely,

Here was my question:

I have been reading about a software synth group where users contribute new patches to share. This N.I. software can use samples. So an ACID loop could be used as a sample in a custom patch. The issue is that loop sample is being distributed to other users as part of the new patch, so someone else could get that loop for free. So at what point is that loop free to distribute or even sell. Can you just add some eq and change the file name? would you need to combine 2 loops and render it out as a new one, would you have to do nothing to it, or could you not do this any any manner?
